Professional Malpractice

Vital Is The Trust We Place In Those Whose Skill We Depend.

Doctors, lawyers and other professionals are not infallible.  Mistakes can happen, and the law is careful not to punish mistakes that do not rise to the level of actionable negligence. However, there are some professionals whose conduct, in certain circumstances, fall far below the standard of care, or whose actions or inaction display a callous indifference for those whom they are called to serve.

As professionals ourselves, we at the Law Office of George G. Romain are careful to analyze the cases we handle against doctors, lawyers and other professionals.  We typically consult with outside expert consultants in the field in which the malpractice is alleged to have occurred, prior to filing suit.  By doing so, we separate ourselves from those law firms that simply take whatever walks through the door.  And in that way, we harbour no guilt in zealously representing the client who clearly suffered injury as a result of the want of care he or she came to expect from his/her doctor, lawyer, agent, broker, accountant, engineer or other professional.

We handle malpractice claims in the following areas:
  • Medical Malpractice – including birth injuries; doctor and nursing errors; surgical errors; misdiagnosis and failure to diagnose; cosmetic surgery errors; nursing home neglect; lack of informed consent case.

  • Nursing Home Neglect & Abuse – you have the right to expect that the nursing home or residential care facility in which you entrust the care of a love one will meet the professional standards required for such critical services.  Should a nursing home or residential care facility fail to fulfill their professional obligation to you or a family member, call us to determine your rights.

  • Legal Malpractice – including failure to file within the statute of limitations; failure to timely comply with court ordered or statutory deadlines; failure to pursue viable claims or defenses; abandonment; failure to adequately prepare transactional documents; failure to properly handle probate and estate matters.

  • Insurance Agents & Brokers – when an insurance agent or broker fails to obtain proper insurance coverage, you can be left without the protection you came to expect.  We believe that you should not have to suffer the consequences of your agent’s or broker’s negligence.

  • Architects, Engineers, Building Contractors – the property you choose to call home, or in which you want to establish a business, is worth every dollar you sacrificed to obtain the pride of ownership.  That is why you have every right to pursue a claim against builders, contractors or other design and building professionals who fail to deliver their services in a workmanlike manner, or whose negligent services require that you to spend more money to undo their shoddy work.  We handle such cases, in which property owners are left with unexpected cost overruns or defects in construction.  Call our office to set-up your free consultation.  We will help you identify and secure a suitable remedy, be it repair or restoration costs, diminution in value, out-of-pocket expenses, and/or other consequential damages.

  • Real Estate Agents – purchasing real property is stressful.  Real estate agents are there to help you research a suitable property, and to make sure that all necessary disclosures have been made.  They are also there to assist you in closing escrow.  When real estate agents perform their services negligently, you can find yourself owning a home or investment property that falls way short of what had been represented to you.   Call our office for an appointment.  We handled cases against real estate agents and brokers who fail to live up to their duty of care.

  • Financial Brokers – although nothing is ever certain on Wall Street, given the inherent volatile nature of the market, you have every right to depend on the skill of your financial broker to decrease that risk.  However, as has been disclosed by the press, and in congressional hearings and other forums, some financial brokers have breached their fiduciary obligations by making recommendations they knew or should have known were disadvantageous to your investment.  Call us if you suspect that you have been victimized by your investment broker.
